These Terms of Use ("Terms") govern your use of OregonLiving.net and its town editions ("OregonLiving.net"). OregonLiving.net is owned, published and maintained by Lucky Duck Productions LLC ("Lucky Duck," "we," "us," "our"), an Oregon limited liability company located in Klamath Falls, Oregon, USA. "Oregon Living" is the brand of the site. By using OregonLiving.net you agree to these Terms. If you do not agree, please do not use it.

2. What the site is

OregonLiving.net publishes community guides and public data about Oregon towns. We build them from public sources and name those sources on each page. Information about hours, dates, rules, prices and availability changes, so check the official source before you rely on it.

3. Third-party content and links

OregonLiving.net links to websites run by cities, counties, schools, visitor bureaus, businesses and others. We do not control those sites and do not guarantee the accuracy, completeness or timeliness of what they publish. Statistics come from public sources such as the U.S. Census Bureau and are estimates with margins of error. We make good-faith efforts to report them accurately, but you should apply your own judgment and do your own research before relying on anything published here.

4. Business listings and advertising

A business appears on OregonLiving.net only when its owner has asked to be included. Advertising and listing arrangements are set out in a separate written agreement or quote. Nothing on the site is an offer that you can accept by using the site. Submitting the advertise form does not create an agreement.

5. Intellectual property

The OregonLiving.net design, text, data compilations and the Oregon Living name and marks belong to Lucky Duck Productions LLC unless a page says otherwise. You may link to us and quote short excerpts with attribution. You may not copy the site, or republish substantial parts of it, without our written permission. Images and third-party material remain the property of their owners and are identified where used.

6. Acceptable use

You agree not to misuse the site: no attempts to disrupt or probe its security, no automated scraping that burdens the servers, no unlawful or fraudulent use, and no use of the contact form to send spam or advertising to us.

7. Limitation of liability

To the maximum extent permitted by Oregon law, OregonLiving.net is provided "as is" and "as available," without warranties beyond those required by law. Lucky Duck is not liable for indirect, incidental, special, consequential or punitive damages, including lost profits or business interruption, arising from your use of the site or reliance on information on it or on linked sites. Our total liability for any claim relating to the free content of the site is limited to the extent the law allows.

8. Governing law and disputes

These Terms are governed by the laws of the State of Oregon. Any dispute will be resolved first by good-faith negotiation; if that fails, by mediation in Klamath County, Oregon; and if mediation fails, by binding arbitration in Klamath County, Oregon under Oregon arbitration rules.

We may update these Terms from time to time. Changes are posted on this page with a revised "Last updated" date.
